TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Indemnification

16. Agreement to Arbitrate and Class Action Waiver (Optional)

If you and we have a dispute arising out of or relating to these Terms or the Services, the parties agree to resolve the dispute through binding, individual arbitration, except as described below. This means you and we generally waive the right to sue in court and the right to a jury trial.

Exceptions

• Either party may bring a claim in small claims court if it qualifies.
• Either party may seek injunctive or equitable relief for misuse of intellectual property or unauthorized access to the Services.

No Class Actions

You and we agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding.

Opt-Out

You may opt out of arbitration within 30 days of your first use of the Services by emailing hello@preciousmetalsreport.com with the subject line "Arbitration Opt-Out" and including your name and a clear statement that you want to opt out of arbitration.

17. Miscellaneous

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
• No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
• Entire agreement: These Terms (and the Privacy Policy) constitute the entire agreement between you and us regarding the Services.
